    Court Orders FG To Take Nnamdi Kanu Back To Kenya

    The Federal High Court sitting in Umuahia, Wednesday, ordered the Federal Government to pay N500 million as damages to the Leader of the Indigenous People of Biafra, IPOB, Mazi Nnamdi Kanu, for forcefully abducting and renditioning him from Kenya in June last year.

    Presiding Judge, Justice Evelyn Anyadike, also declared Kanu’s extraordinary rendition from Kenya as illegal and a gross violation of his fundamental human rights.

    Kanu, had through his Special Counsel, Mr Aloy Ejimakor, challenged his “abduction and extraordinary rendition from Kenya without any court warrant”, and demanded his restitution to his country of abode, Britain or Kenya where he was before the abduction in June 19, 2021.

    Kanu’s lawyer also asked the court to “redress the myriad of violations that came with his rendition, such as the torture, unlawful detention and the denial of the right to fair hearing which is required by law before anybody can be expelled from one country to the other.

    He demanded N25 billion as damages for the gross violation of his rights and the torture he was subjected to both in Kenya and Nigeria.

    Meanwhile, the Federal Government in its preliminary objections, argued that the matter had already been entertained by the Abia High and that the said incident did not occur within the jurisdiction of the court.

    But the court struck out the preliminary objections, saying that where an incident occurred in two states any federal high court in either of the states had jurisdiction over the matter, stressing that violation of Kanu’s rights began in Afaraukwu Umuahia and continued in Kenya.

    The Court also held that Kanu’s lawyer had successfully established a case of torture against his client which the defendants laboured in vain to deflate.

    In considering the prayer for damages, Justice Anyadike held that Kanu had been “exposed to global ridicule which requires global cleansing”.

    The Court, therefore, awarded N500 million in damages against the Federal Government.

    The Respondents had no representation in the Court but Kanu’s lawyer, Ejimakor thanked the court for granting justice to his client.

    Later in an interview, Ejimakor said the judgement was a victory for the oppressed people and commended the judiciary for remaining the last hope of the common man.

    He urged the Federal Government to obey the judgement and other similar rulings in Kanu’s favour and release him without further delay.

    Ejimakor further told the Federal Government to return Kanu to Kenya where he was before his abduction by the agents of the Government on June 19 2021.

    He insisted that IPOB is not a terror organisation contrary to claims by the Federal Government.

    Ejimakor said that terror organisations do not have Defense Counsel anywhere in the world unlike IPOB which has identifiable lawyers all over the world.

    He called for the de-proscription of the pro-Biafra movement and the release of all its members in different security detention facilities.

    Other members of Kanu’s legal team present at the court were Patrick Agazie, Ifeyinwa Nworgu, Tochukwu Arugbuonye, Franklin Amandi, Ohaeto Uwazie and Mandela Umegborogu.

    National President of Ohanaeze Youth Council, OYC, Igboayaka. O Igboayaka was also present at the court.

    Igboayaka called on President Buhari to show he had respect for the rule of law and release Kanu without further hesitations.

    He said that the entire Igbo youths both at home and abroad had continued to stand firm behind Kanu who he described as a rare hero.

    Below are the eight-point reliefs sought by Kanu which were all granted except the N25 billion in damages which was slashed to N500 million:

    “1, A DECLARATION that the arrest of the Applicant in Kenya by the Respondents’ agents without due process of law is arbitrary, and the Respondents’ enforced disappearance of the Applicant for eight (8) days and their refusal to produce the Applicant before a Kenyan Court for the purpose of Applicant’s extradition are illegal, unlawful, unconstitutional and amount to infringement of the Applicant’s fundamental right against arbitrary arrest, to his personal liberty and to fair hearing as enshrined and guaranteed under the pertinent provisions of CFRN and the Charter.

    “2, A DECLARATION that the detention of the Applicant in a non-official secret facility in Kenya and the torture of the Applicant in Kenya by the Respondents’ agents is illegal, unlawful, unconstitutional and amount to infringement of the Applicant’s fundamental right against unlawful detention, torture and to a fair hearing, as enshrined and guaranteed under the pertinent provisions of CFRN and the Charter).

    “3, A DECLARATION that pursuant to Article 12(4) of the Charter, the expulsion (or extraordinary rendition) of the Applicant from Kenya to Nigeria by the Respondents without a decision taken in accordance with the law of Kenya is illegal, unlawful, unconstitutional and amounts to infringement of the Applicant’s fundamental right to a fair hearing and not to be expelled from a State Party to the Charter except by virtue of a decision taken in accordance with the law, as enshrined and guaranteed under the pertinent provisions of CFRN and the Charter.

    “4, A DECLARATION that any criminal prosecution of the Applicant for the purpose of which the Respondents unlawfully expelled the Applicant from Kenya to Nigeria is illegal, unlawful, unconstitutional and amounts to infringement of the Applicant’s fundamental right to fair hearing, as enshrined and guaranteed under the pertinent provisions of CFRN and the Charter.

    “5, AN ORDER OF INJUNCTION restraining and prohibiting the Respondents from taking any further step in any criminal prosecution of the Applicant enabled by the said unlawful expulsion of the Applicant from Kenya to Nigeria.

    “6, AN ORDER mandating and compelling the Respondents to forthwith restitute or otherwise restore the Applicant to his liberty, same being his state of being as of 19th June 2021; and to thereupon repatriate the Applicant to his country of lawful domicile (to wit: the United Kingdom) to await the outcome of any formal request the Respondents may file before the competent authorities in Britain for the lawful extradition of the Applicant to Nigeria.

    “7, AN ORDER mandating and compelling the Respondents to issue an official Letter of Apology to the Applicant for the infringement of his fundamental rights; and publication of said Letter of Apology in three (3) national dailies.

    “8, AN ORDER mandating and compelling the Respondents to pay the sum of N25,000,000,000.00 (Twenty-Five Billion Naira) to the Applicant, being monetary damages claimed by the Applicant against the Respondents jointly and severally for the physical, mental, emotional, psychological, property and other damages suffered by the Applicant as a result of the infringements of Applicant’s fundamental rights by the Respondents.”

    Only 1 Guber Candidate Appeared for NDLEA Integrity Test – INEC

    National Drug Law Enforcement Agency, NDLEA, says only one candidate across all political parties contesting for various positions appeared for integrity test in Katsina State.

    NDLEA Commander in the state, Muhammed Bashir, disclosed this in an interview with the News Agency of Nigeria on Tuesday in Katsina.

    According to him, only the People’s Redemption Party, PRP, governorship candidate, Imran Jino, visited the agency for the test, adding that he tested free.

    He urged politicians contesting for various political positions in the state to come for the test, saying that this would, in turn, be a message to their supporters.

    The NDLEA commander added that doing such by the politicians would encourage their supporters to shun drug abuse.

    “Politicians should not encourage those using drugs within their campaign environment, and we are still advising them to come up for integrity tests.

    “I’m happy that one of the governorship candidates has done that; others should take a cue from that.

    “If your supporter sees that you’ve come for a test and you are free, he/she will know that you are not going to encourage use of substance during your campaign,” he said.

    According to him, the ongoing electioneering ahead of the 2023 general elections can only be free, fair and peaceful if politicians caution their supporters against drug abuse.

    “As a politician, you don’t need to give drugs to your supporters for them to be able to support you and you don’t need to be violent.

    “We usually say that drug abuse is the mother of all crimes. If you’re giving them drugs, you are encouraging them to go into other crimes.

    “It then means that campaign will not be free and the election is not likely going to be free and fair too,” he said.

    While urging politicians to engage in issue-based campaign, Mr Bashir said that they should desist from giving their supporters drugs and caution them against selling drugs at campaign grounds.

  • Give Priority To Persons With Disabilities – Lalu Charges Officials in Flood Ravaged States

    The Federal Government through the National Commission For Persons With Disabilities, NCPWD, in collaboration with the National Emergency Management Agency, NEMA and the Ministry of Humanitarian Affairs, Disaster Management and Social Development, have commiserated with Persons with disabilities who are victims of ravaging flood in some part of the country adding that, the government is working tirelessly to cater for them in this trying time.

    The Executive Secretary of NCPWD, Mr James David Lalu had earlier called on frontline humanitarian actors in this regard to always consider Persons with Disabilities first and give priority to them when evacuating affected people.

    Lalu in a release made available to Vreporters on Tuesday said Persons with Disability across the affected states can contact the Commission through its 24/7 rapid response WhatsApp hotline: +2347015370083 when there is need for evacuation.

    Lalu added that the commission under his watch is working very closely NEMA towards ensuring that no life of Person With Disability is lost to this disaster.

    The release read in part “Our essential team at the Commission is fully ready, working 24/7 to ensure that affected Persons with Disabilities are evacuated at any location.

    “I therefore urge the community to remain calm as we continue working towards providing humanitarian assistance and protecting the lives of all Persons with Disabilities in Nigeria.

    “I will also like to use this opportunity to sympathize with parents and the Ugandan Government over the fire outbreak at a school for the Blind Children in Mukono, Kampala on Tuesday morning which led to the loss of lives of Persons with Disabilities.

    “May the Almighty have mercy upon them and grant the parents the fortitude to bear the loss” .

    The Peoples Democratic Party, PDP, presidential candidate, Alhaji Atiku Abubakar, has hinged the devastating flood to the impact of climate change, saying the phenomenon was real.

    Abubakar, who spoke in Government House, Yenagoa, during a sympathy visit to the Bayelsa State Governor, Douye Diri, on Tuesday, donated a total sum of N55m to flood victims in the state.

    Abubakar, who announced a donation of N50m while with Diri and another N5m at the Oxbow Lake IDP camp in the state capital, said the gesture was his token to support the recovery process of those affected by the flood.

    He said, “My visit to Yenagoa is to have a personal experience of the devastation that victims of flooding have suffered across the country. Climate change is real. The experience in Bayelsa is disheartening. Human lives and public infrastructure have been destroyed.”

    Describing the disaster as disheartening, Abubakar lamented its effect on the lives and economy of people of the state and called on the Federal Government and public-spirited individuals and organisations to support Bayelsa in this difficult moment.

    The former Vice President advocated the setting up of an independent flood disaster relief fund that will provide succour to victims and a temporary fund for farmers to ameliorate their losses and provide them with capital for next year’s planting season.

    He also urged the Federal Government to build the required infrastructure to contain excess waters.

    He said if elected president, he would commit to completing the dam in Adamawa State and take other necessary measures to ensure that Nigeria does not suffer this magnitude of damage as a result of flooding.

    The PDP candidate also offered scholarship up to university level to children of the late footballer, Ernest Peremobowei, who drowned after saving five other victims of the flood in a boat mishap.

    “People who are likely to survive this flood have lost their livelihood and need every ounce of support they can get. I commiserate with them.

    “On my part and on behalf of my family, I wish to announce the sum of N50 million and call on my friends in the corporate world to also assist the victims of flood,” Abubakar added.

    Governor Diri said people of the state were encouraged by the display of love by the former Vice President.

    Diri, while confirming receipt of the donation, said he was the first presidential candidate to donate such amount, assuring that the money will be paid into the flood relief account for the benefit of victims.

    Diri lamented the slow response of the Federal Government despite several efforts by him to get the attention of the relevant authorities.

    He stressed that Bayelsa remains the state that lays the golden egg where oil was first struck in commercial quantity and wondered why the Federal Government was yet to give the state the attention it deserved.

    The Bayelsa governor described Atiku as a caring father who has brought hope to people of the state and expressed optimism that he will win next year’s presidential election and work with the state to find lasting solutions to the issue of flooding.

    He dismissed suggestions that the flooding was caused by rainfall, insisting that waters from the Lagdo dam and issues of climate change were responsible.

  • INEC Fixes Date For Imo, Bayelsa, Kogi Guber Elections

    The Independent National Electoral Commission (INEC) has scheduled the Imo, Bayelsa and Kogi governorship polls for November 11, 2023.

    The Commission approved the timetable at its weekly meeting on Tuesday.

    It fixed primary elections by parties for March 27 to April 17, 2023.

    According to a statement by INEC National Commissioner and Chairman Information and Voter Education Committee, Festus Okoye: “This decision is in fulfillment of the requirement of Section 28(1) of the Electoral Act 2022 which mandates the Commission to publish the Notice of Election not later than 360 days before the date fixed for the elections.

    “Similarly, Sections 178(1) and (2) of the Constitution of the Federal Republic of Nigeria 1999 mandates the Commission to conduct such elections not earlier than 150 days and not later than 30 days before the expiration of the term of the last holder of the office”.

    It added: “The tenure of the incumbent Governor of Imo State ends on 14th January 2024 while those of Kogi and Beyelsa States end on 26th January 2024 and 13th February 2024 respectively.

    “Accordingly, the Commission has decided to conduct the three elections on Saturday 11th November 2023.

    “The statutory Notice for the elections will be published in the three States on 14th November 2022. Party primaries will be held from 27th March to 17th April 2023, while the online portal for the submission of nomination forms (EC9 and EC9B) by political parties opens at 9.00am on 24th April 2023 and closes at 6.00pm on 5th May 2023.

    “The final list of candidates will be published on 9th June 2023 while campaign by political parties commences on 14th June 2023 and ends at midnight on 9th November 2023.

    “The full Timetable and Schedule of Activities has been uploaded to the Commission’s website and social media platforms”.

  • Strike: Release Withheld Salaries of ASUU Members – NLC Urges FG

    The Nigeria Labour Congress, NLC on Tuesday urged the Federal Government to release the withheld salaries of the members of the Academic Staff Union of Universities, ASUU.

    The Labour union made this known in a communique made available at the National Executive Council meeting held in Birnin-Kebbi, Kebbi State.

    In the communique, the body said, “NEC noted the collapse of effective collective bargaining machinery in the tertiary education sub-sector.

    “This fact is buttressed by the recent protracted industrial dispute in public universities in the country which was consummated in industrial litigation, arm-twisting of conciliation efforts and extreme violations of human and trade union rights, withholding of the salaries of university workers and interference in trade union activities including balkanization of trade unions in the tertiary education sub-sector and overt threats to proscribe existing trade unions.

    “The NEC resolved as follows: Called on Government to honour all collective bargaining agreements with unions in the tertiary education sub-sector, especially with regards to wages and conditions of service and increase budgetary allocation to the education sector;

    “Called for the release of withheld salary owed university workers. Rejects the “no work – no pay” policy of government;

    “Called on the Minister of Labour and Employment to respect the provisions of Nigeria’s Constitution, Trade Unions Act (CAP T14 Laws of the Federation of Nigeria), Conventions 87 and 98 of the International Labour Organisation on respect for trade union independence, promotion of tripartism and social dialogue in the exercise of his mandate as a Minister.

    “NEC further resolved to defend trade union independence as guaranteed by the clear provisions of our labour laws”.

    According to ABN TV, the Imo State chapters of the National Human Right Commission and the Nigeria Association of Women Journalists have called on the Imo State Government and police to immediately arrest and prosecute Amatobi for the assault.

    The baby’s arm was amputated at the paediatrics ward of the Federal Medical Centre, FMC Owerri.

  • Flooding: NAF Airlifts Relief Materials To Bayelsa Communities

    The Nigerian Air Force (NAF) said it has commenced the airlift of relief materials to riverine communities in Bayelsa State affected by the recent flooding.

    The relief materials, which were airlifted from Enugu State to Igbogenne community in Bayelsa State via Port Harcourt, the force said will be redistributed to other riverine communities adversely affected by the recent flooding in the State.

    A statement from the NAF spokesman, Air Commodore Edward Gabkwet said the airlift of the relief materials also aligns with the Chief of the Air Staff, Air Marshal Oladayo Amao’s directive to all operational units and commanders to ensure they provide the necessary assistance required by all government agencies towards alleviating the sufferings of Nigerians affected by this year’s unprecedented flooding in some parts of the country.

    The statement said the relief materials were airlifted by the C-130 aircraft from Enugu to Port Harcourt and subsequently ferried to Igbogenne in Bayelsa State using the Mi-35M and EC-135 helicopters where it was then redistributed to affected communities and villages. More relief materials are expected to be airlifted in the coming days from other parts of the country to affected flooded communities in Bayelsa State and other States in the country.

    The NAF has a long history of providing aids in form of airlift to civil authourities. Recall that in March 2020, the NAF airlifted medical materials donated by the Jack Ma foundation consisting of 107 boxes of medical supplies and equipment weighing over 1,360kg. Also, in April 2020, the NAF airlifted medical equipment and supplies donated by the Turkish government from Lagos to Abuja. Additionally, in March 2021, the NAF airlifted Covid-19 medical relief materials donated by the Economic Community of West Africa States.
